Kramer Alberti Secures Important IPR Victory for Client Adaptive Spectrum and Signal Alignment, Inc. (ASSIA)

April 24, 2025

Kramer Alberti obtained an important denial of a PTAB inter partes review petition of U.S. Patent No. 7,809,996 for client and patent owner Adaptive Spectrum and Signal Alignment, Inc. (“ASSIA”). The IPR is PTAB IPR2024-01379, Charter Communications, Inc. v. Adaptive Spectrum and Signal Alignment, Inc.

The ’996 patent is directed to an innovative technique for improving digital communications systems performance. The inventor, Dr. John M. Cioffi, is renowned for his transformative contributions to telecommunications. He is a Professor Emeritus at Stanford University and received, among many other accolades, the National Medal of Technology and Innovation, awarded by the President of the United States “for advancements that helped bring high-speed Internet to the world.”

“This IPR victory is related to a co-pending district court case that our firm will take to trial against Charter in September 2025 in Marshall, Texas,” explained Kramer Alberti partner and lead counsel for ASSIA, Rob Kramer. “This denial of institution is a well-deserved and hard-fought victory for ASSIA,” added Kramer Alberti partner Dave Alberti.

To secure the IPR victory for ASSIA , the Kramer Alberti team co-counseled in the PTAB with attorneys from Sterne, Kessler, Goldstein & Fox, PLLC, with whom they have a strong relationship. Opposing counsel representing Charter Communications in the district court case against ASSIA, and related IPR, are Quinn Emanuel Urquhart & Sullivan, LLP, Greenberg Traurig, LLP, and Proskauer Rose LLP.
