Kramer Alberti Wins Nine Figure Patent Verdict of $173M – Largest in Sherman, Texas Courthouse History
Kramer Alberti today secured a record-setting, unanimous jury verdict for its client, Wapp Tech LP, against a Hewlett Packard Enterprise Co. spinoff and its parent company, Micro Focus (US) Inc. The $172.6 million award, the full amount sought by the plaintiff, was the largest ever in the Sherman Division of the Eastern District of Texas.
Lead counsel for the Kramer Alberti team was Rob Kramer. He was supported by David Alberti, Sal Lim, Russell Tonkovich, Sven Raz, Andrew Hamill, and others. Jury deliberations lasted less than three-hours, and the unanimous verdict affirmed the client Wapp Tech’s claims that the HPE spinoff and its parent company Micro Focus (US) Inc. were liable for willful infringement of three Wapp Tech patents. The case thereafter settled for a substantial, high eight-figure sum paid to Kramer Alberti’s client. The Kramer Alberti team was included on the National Law Journal’s List of annual “100 Largest Verdicts in the U.S” and honored to be named on Texas Lawyer Magazine’s “Top 10 Patent Infringement Verdicts of the Year” for this victory.
